The Alcohol Policy Information System, a project of the National Institute on Alcohol Abuse and Alcoholism, outlines several issues that can lead to legal troubles for an underage drinker/driver in South Carolina:
- Possession of alcohol is prohibited for minors except in a young person's parent's or guardian's home.
- Consumption of alcohol by minors is prohibited with no exceptions.
- Underage individuals may not purchase alcohol except for law enforcement purposes.
- Furnishing alcohol to minors is prohibited except by the parent, guardian or spouse of the minor, at home.
- Use of a false ID to obtain alcohol is a criminal offense. Violation of this prohibition may include driver's license suspension.
- Retailers may be charged with a crime after selling alcohol to minors, even if a retailer believed a purchaser was at least 21 years old.
- A blood alcohol content higher than .02 is considered to be evidence of a violation. This is much higher than the legal limit for adults.
- An underage driver who purchases, possesses or consumes alcohol will be subject to driver's license suspension, revocation or denial.
